Lien on Real PropertyWhat is the name of your state? I live in Pennsylvania. If I someone is 50% owner on a mortgage, has not paid closing costs, any taxes, any property dues or mortgage payments, can put a lien on another home that they own? With this other home, the debtor is not on the mortgage of the property, but her name is on the deed to it. Can I even put a lien on her other home since she's not on the mortgage, or does her being on the deed of the property give me legal standing to put a lien on the home? How would I go about putting a lien on her property if I can? |

| Mortgages do not determine ownership nor do they have ownership. Each person listed on the mortgage is fully responsible for making the payments. If I understand your run-on sentence, they owe you money for what you perceive is their share of your commonly owned house and you want to file a lien on other property they own separately? No, you'd first have to sue them for money owed and then you might be able to lien their property to satisfy the judgment. |
