The deed to property was signed over in 1993 to the grandchildren. On the last page of deed it states: The life tenants as set forth herein shall be jointly and severally responsible for the payment of taxes, insurance, and reasonable repair of the premises so long as one of them is living. We have all been asked to sign the property back to the one surviving original owner. She is now 76 years old. Her son is pushing all to sign over to her. This is not what the grandfather wanted for his grandchildren.
Now the threats are flying.....they will make repairs to the homes and property and send everyone listed on the deed (21 people) a bill to pay for repairs. Currently there are 3 people residing there who are indeed life tenants. All others have their own seperate homes. The son is surrently losing his home to forclosure and wants we believe all rights to the property for himself. Unfortunately this is not what the grandfather wanted, but he left no will, trust, and there was no probate of his estate as it was under 3000.00.
Who is responsible?? Do we all share that or is it the people who are actually occupying the property? One granddaughter offered to take over and was told no. The grandmother would sell it to her if she signs it over to her. We know that is not true.
Also the property has been improved over the course of many years and never been reassesed. The taxes being charged are on the original single home. All building was done without permits and our taxing authorities have no clue that this property now has 3 full homes and an apartment on it. The life tenants who are currently living there have not done ANY repairs or up keep, there is no insurance on the property either. The taxes have been paid though.
