| Listing Agreement for sale of R/E What is the name of your state? Pennsylvania
I have a question about the validity or enforceability of a listing contract with a broker that has not be signed by both fee owners of the property, and the one party that did not did not have power-of-attorney from the other owner to sign.
The facts are husband and wife own property T/E, and agreed that they wanted to sell the property, and find a realtor to list it. Husband found a realtor and signed a listing agreement in his name only. Wife's name was not shown as a party to the agreement, nor did the wife sign the original of the agreement as the co-owner. Wife does not want this realtor to handle this sale. Is the contract valid, enforceable, void, voidable, etc.? |
