We purchased a house in Delaware five years ago. We were told that 3 feet of the front yard were in the floodplain and we carry flood insurance. There is a storm sewer drain located on the property behind and the Seller's stated that during heavy or prolonged rains ponding in the back of the yard by the drain could occur. Ponding does not begin to describe what we experience. Our entire yard is submerged under anywhere from 2-3 feet of water and the house is surround several times a year, so basically we live on an island. We were flood in 1999, and in are going back and forth with the city/state, it has been determined that the primary source of this water is from the storm system surcharging. So, in our opinion, the city is basically using our yard/property as a gigantic catch basin, if the water was not in our yard, it would be flooding the streets, creating a major problem for all residents. As it is now it only impacts us. Does this fall under eminent domain (using our property to their benefit, with no compensation to us). We have requested to put up a retaining wall and fill the yard in, but that request has been denied. The neighbors along either side of us put walls up and filled their yards in, which effectively blocked our property in so the water does not have anywhere to else to go! Help, we feel we are being royaly jerked around!
