What is the name of your state (only U.S. law)? PA

Recently (1-3-08), we purchased a home in Franklin County Pa in the city of Greencastle, on the discloser it stated a repair of the septic system was done. We requested several times from our realtor the description and the extent of the repairs/problem. This was never given and the closing was to us, rushed. After three weeks in the home the system backed up. After conducting our own investigation we found the system was repaired without a permit and it should not have and did not pass final inspection. Our realtor falsified the inspection documents by covering over the failed part of the paper and submitted it. Also we found our realtor is friends with the seller. The seller has accepted full responsibility of the faulty repairs and is willing to pay 100% for all repairs. This was agreed only after we contacted a lawyer. We now know all the evidence of this case and our realtor did play a major roll in deceiving us. Also, we want to take action against our realtor. Can you please help us?

Report the realtor to whatever licensing agency oversees her.

Other than that (and getting the repair fully paid for), what else are you looking for?

We have a 20x20 foot area of our yard, which is seeping sewage! At the present time, it's more of an inconvenience that we have to have the tank (1000gal) pumped often or the pipes will seep into the yard, our yard dug up and part unusable. Now the new system is taken away from the useable acreage by, having a big sand mound on the side of our yard and a 3x3 box between the system and tank.

**A: contact EPA and the state Dept. of Health as they may have procedures on mitigating the soil etc.

That sand mound (mound style septic system ) would have happened sooner or later anyway since that is what the county /city required to help protect ground water sources. Sounds like your only concern should be if there are extra cost related to any requirement for soil cleanups. Its great that the seller is going to pay for the replacement of the system. With proper care this septic system could last you 30 to 40 yrs as long as you NEVER treat it like a city sewer. This means no paint roller washing in sinks, no food garbage, lint trap for your washer, limited use of bleach and cleaning products ETC , many states universitys have good information in web sites about caring for the system. Carefully look at all the realtors docs fair odds are that they say something to the effect of the realtor not being responsible for errors regarding listing information ETC.
