What can I do to stop tree damages personal property legaly?tree ready to fall on my house . Ok I found I am to late to file because of the limitations. but question here now is 1. can I legaly go up verticily and cut all the branches off on side of the property line? 2. after talking to my insurance agent he informed if I persue this the insurance co. the will canceal my policy because it now beomes a risk is this right? 3.what are my other options here to prevent damges? | Your first option is to go back to your original post and edit it because it does not make any sense. And also put the state where you are located in. |

| OK I live in Kansas. and one week ago I posted here for help(here is the link to prior post [url]http://forum.freeadvice.com/showthread.php?t=178200[/url] ) about a tree that was ready to fall onto my house at any time. This tree is a siberian elm. I looked it up and it has a very shallow root system and when top heavy like the one leaning over my house with winds expected to reach 40mph gust it may leaning more if completely fallen over. with every wind storm it leans more and more towards more house. Two years ago I had another from same neighbors property fall onto my property doing substantial damage I had to pay out of my pocket because insurance company said it was an act of god the tree fell. Plus the neighbors refused to pay. Well timed frame lapsed as for court time by two weeks so I cann't go to small claims court for action there. so now I am curently trying to stop this from happening again if I can by any legal means. this is why I ask the the questions as posted above. so I post them here again.
