monies owned


in las vegas
i bought a townhome in june of 2002. there was litigation by the assoc. for the complex on the properties there and they settled . the money that was given was for repairs on the townhome. but the seller took that money and did no repairs on the home . i'm i entitled to these money because he didn't do any repairs or is the money his????

**A: since this issue was not part of your purchase contract, you are not entitled, provided the Seller got the money prior to your closing.
How come you did not know about this issue, prior to closing?

the seller did not get the monies prior but after the close of the home!!!!!!!!!!!!!

Then hire an attorney to review your contract.
Did you not review the condo docs and inquired of the HOA as to lawsuits, settlements etc. after you made the offer to purchase?

hoa of this complex knew of the lawsuit and knew that they were distributing the checks and that the seller was getting one of these checks..i wrote the seller a letter certified mail telling him that he was to compensate me for the repairs and his answer was that he paid me 3 points and also that the remaining repairs were minor and that i should pay for them.. no money for attorney!!!!!!!!!!

This is a complicated real estate contract matter and without an attorney to help you, you are basically out of luck.
