Mortgage company holds title

What is the name of your state? New York
If a person dies and their home is highly mortgaged does the mortgage company have first rights? This person has no children and lives alone. The closest relative is a brother. The home is in poor condition and the brother does not really want it.

It is owned by the estate of the decedant..
