We bought house about 3 yrs. ago. Mortgage was bought & sold 3 times. Current mortgage company has started foreclosure, currently awaiting 6th. or 7th. sale date in last year. It keeps getting extended due to them not providing payoff for re-finance. They claimed missed payments. We proved numorous times via cancelled checks and documents that they recieved payment. Court ordered them to work with us. Still after nearly a year they refuse to give accurate payoff or credit us payments we proved they got. Questions: Do we have any action against them for failure to act in good faith or trying to delay our refinance. We had at one time a rate of 6.75%. Now we are faced with 11.5 % or more due to them dragging this out.
