my neighbor, our easements and a fence

What is the name of your state? Massachusetts.

We recently purchased a home in Ma., and there is an access easement that is 20' wide between our boundaries and our neighbors. After having the lot surveyed, we found that our neighbor is encroaching on our land as much as 7' in some areas. He has a vehicle, fence and a lot of other items in this strip of land. We informed him that we intended to install a fence, and he claims we cannot because of the access easement. Can we? Also he threatened us with taking us to land court if we pursued the encroachment issue, as we have a common driveway into our properties...a right of way. He cannot take control of a right of way can he??? So much for people behaving neighborly. Any help is much appreciated.
