In NY state if a tenat is given 60 days notice to vacate premises because the house was sold, does the tenant have to give 30 days written notice to the landlord if they are leaving before the specified date? AND....
Can a landlord in NY state keep security for normal wear and tear (ie painting and picture holes)?

Dear Out of Time Rene, if you nailed stuff to the wall to hang pictures and damaged the walls, you are responsible for repair to the walls and painting the walls if needed. These types of damages are not considered normal wear and tear but damages caused by the tenant. Did you have the carpets cleaned? Are the appliances and plumbing fixtures cleaned?

Also were you a month to month tenant?

If you had a lease and it wasn't over with then the landlord evicting you was Illegal

Also in NY you have a LEGAL right to attend the closing and make a demand for your security back, or an accounting of the damages...no kidding...

Once its sold you are out of luck trying to get any money back

Also go out and buy 2 or 3 of those diposable cameras and take lots of pictures, and then go to a one hour place and make an extra set....now you have proof of any and all damages... the kitchen sink, bathtub, stive carpeting....do it while he is there it will intimidate the Landlord.

It will be the best $40 youll ever spend.
