Question

natural Gas Well/ 50% mineral rights


What is the name of your state? Colorado.

Hello. I have an oil company that is going to drill on my property even if I do not want them to. this is because I only have 50% mineral rights and someone else has the other, they of course have the right to have their minerals recovered, so I am in this even if I don't want to. What I am trying to do is become informed. I want to find out what standards are for my portion of the mineral rights, and what I can hold the company responsible for etc. They will be contacting me soon and will want to nogotiate this deal, before the drill and I want to make sure I am getting a great deal and not getting a bad one.

Any suggestions out there?

You need to read the original lease. If there is no lease, then see if the original reservation on the deed spells it out.

If there are no details on the reservation deed, then talk to a minerals lawyer in Colorado.

The mining company has certain duties under Colorado law.

do you have any additional ideas


Hello;

I am currently part of a colition that has hired an attorney to represent us on this issue. however I am still concerned that I do not have enough information to know if we are getting a good deal or not.

do you have any suggestions as to books, or legal documents that can give me an idea of what my options are, or what the industry standards might be?

I know that the attorney is working on this, but I would still like to be informed about the situation before we get to the bargining table.
