I put up a privacy fence at my new home. It is at least a few inches inside the property line. i have always been told that if a neighbor wants to hook onto the fence, they are suppose to pay half of the cost of the fence they are using. My new neighbor is in the process of putting up fence. In order for him to not have a gap, he will need to hook to my fence, or put up his own fence backing onto mine. If he hooks to my fence, and refuses to pay me, what recourse do I have? Can the police handle the problem, or would I have to take him to small claims court, or what?What is the name of your state? Texas | You could take him to small claims court, seeking half the value of the fence, but you would LOSE.
You can request that the neighbor not trespass a few inches over your property line and damage your property.
But like pojo2 implied, is it worth all the hassle?

I am attached on one side to a fence and the the other 2 full sides are attached to by my neighbors and we all just yelled across the fence hey can I secure this little gap and everyones reply was you didn't even need to ask such a question! |

| | | You can allways send them a certifed letter that is polite but firm, telling them you dont want them to attach to your fence post but would be more than happy to assist them in comming up with a solution that closes up any gap with out attaching to your property or putting in a post next to your fence if post would still be on your property. You can tell them this way neither of your homes future property owners will ever have any sort of hassle /headache some day due to actions taken now. ( hell invite them over in the letter for iced tea or something so you can both come up with solutions that will be friendly and cause no grief between you) my neighbor and I both smiled we marked the corners with pipe i was pounding in , we had same idea , easy markers to help prevent problems. | |
