neighbor wants me to cut my trees


I live in California. The owner next door built an in-law unit near our joining property line. He now wants me to cut my trees down because he feels that they threaten his rental. He sent me a certified letter stating that there will be no insurance coverage if one of the trees does fall and I will be personally liable. I happen to be a landscape contractor. In my own opinion, the trees are stable. Is there any liability here?

Food for thought . Since your neighbor is so very concerned about your trees . Did your neighbor build that 2nd unit with a permit from your city/county ? Does the unit meet local setback codes ? If the houses in your area are not on city water and sewer then does the extra units septic system meet code and setbacks from your own property and your well ? Is there any zoning restrictions on creating rental unit in your area (since you also refered to it as a rental )

**A: possibly. but only if the tree does fall and it makes a sound and does some damage. Otherwise tell the neighbor to trim the branches on his property.
