Question

Neighbor wants to put up a fence in California


California Neighbor wants to put up a fence in his front yard. Our concrete driveways are side by side. His fence will block the line of sight of my property from the street. Can he put the fence up if I don't want it? If he wants to put it up does he need my permission? Does he need to pay me for blocking my properties line of sight and my view?

My response:

In the order of the questions asked:

1. Yes.

2. No.

3. No.

California has numerous case law on this subject, and the sum and substance is that you have no claim for "line of sight" or "sunlight" or "views". Sorry.

Call your City hall and ask what the local ordinances are about fences , height setback from street ,setback from adjoining property . Most citys will be more than happy to tell you or send you information .
