What is the name of your state (only U.S. law)? Nevada

The declarant has changed the CC&Rs. While this is permissable as they still held the majority of lots, they did not provide copies within 30 days as required under the old CC&Rs amendments section (we are already filing with the Nevada Ombudsmen's office on the validity of the new CC&Rs because of this).

The question is simple (I hope):

Until the new CC&Rs were filed (July 1, 2008), were the homeowners governed under the old CC&Rs?

The reason for the question: As declarant and majority of the ARC, the builder allowed certain improvements by homeowners prior to July 1, 2008 to sell additional homes that were in viloation of the CC&Rs that governed at the time the improvements were approved. Those restrictions are no longer in the new CC&Rs.
