New Construction Propertly Line Issues


What is the name of your state? Michigan

I just built a house in a new subdivision. My neighbor built a house a year ago and has an established lawn on his property. When he laid his sod, the property line was inaccurately drawn and he sodded about 10 feet onto my lot, before I purchased my lot and started construction.

Now that I've moved in, he wanted to expand his yard in the back and is cutting out the sod on my lot and moving it. My question is, who actually owns the sod? He started moving it without informing me, am I responsible if he hurts himself on my land? I'm concerned since I haven't had final grade yet and there are plenty of ruts, crevices, and rocks for ankle twists, etc.

**A: you own the sod and the land thereon and therefore have liability if an accident occurs on your land.
