we own a home in south carolina and the local telephone company wants a new easement along the side of our property. should they be expected to pay for this usage and, if so, how would that be calculated?

also, the fence in our backyard does not run along the property line and our neighbor mows the unenclosed area and may have planted two trees (which were in place when we moved in). we bought the house two and a half years ago, and have had no contact with the neighbor. how could we protect our property rights without offending him?
