What is the name of your state? California

Refinanced in 1999, mortage co went bankrupt, no deed of trust was filed, mortage management co now has loan, but doesnt have original loan papers only bad copies, recorders office wont record without originals, can we refinance without having to pay the prepayment penalty it was for 5 yrs? want to clean up this mess?

**A: I am confused as to exactly what you are trying to do.
A deed should have already been filed and your mortgage recorded on title. If a new mortgage co. takes over, there is no need to file anything new as the original mortgage is still in place.
The recorder's office should have all copies of recorded documents. On a refi, there is a new mortgage recorded,not a new deed.

no deed of trust was ever filed on refinance in 1999, so only have origignal deed . cant refinance without paying penenltys.
mortage co went bankrupt and took everything oringinal with them on original bank notes. money management only has copies to work with. what are our options? cant do home inprovments without deed of trust filed. at recorders they only have last finace release of deed of trust. deed shows free and clear. place help need advice. Gregtenaj

**A: I still do not understand your situation.
If you have clear title there should be no problem.
What are the penalties for if there is no mortgage on title?
