Now charging for Quit Claim DeedWhat is the name of your state (only U.S. law)? FT Lauderdale FL Please Help! About 2 years ago my fiance quit claimed me to his property. We did not do a refinance, I am not on the mortgage, we simply wanted to add myself to the property. Since then (about 1 yr. ago) we removed myself from the property. Situation is as follows: About 20 days ago we recieved a letter stating that we now owe approximately $1600 for adding me on. We are in the process of foreclosing on the home with a possible short sale pending, if it doesnt foreclose before it goes through. Help: 1. If the short sale goes through, will we still be responsible for paying that money 2. If we dont pay, will the lien be put on the house or on my fiance? 3. I am thinking we will also get notified that we owe for removing me as well? We are replying to the letter as requested informing them that we don't have the money to pay and we are losing the home. Does anyone have any direction please? Thank you~ |

| I can't understand quite what is going on because of your abuse of the terminology. If he quit claimed interest to you, it has no bearing on liability for the mortgage. Similarly, any quit claim of your interest back, doesn't change it either. Borrowers do not foreclose. Lenders foreclose. What is the nature of this $1600 fee? Did you apply to be added to the mortgage? 1. The whole point of a short sale is the bank forgives the balance of the loan. You won't get a short sale approved without already being in default. 2. There is already a lien on the house. That's what a mortgage entails from the day you take it out. Liens are attached to property, judgments are applied to people. Judgments usually follow foreclosures. 3. I'm still clueless as to what you are talking about. You can not remove yourself from mortgages. If you got yourself added to the mortgage, you're not getting off short of paying off the loan or being foreclosed. Quit claiming away your interest doesn't get you off the loan.
