Nuisance neighbor

What is the name of your state? North Carolina

We have a relatively new neighbor who moved in Feb. 2002. Since then, we have had problems with him letting his dogs run loose, letting the dogs bark up to an hour without attending to them and a long list of other nuisance behavior. We tried talking to him in the beginning but just got a lot of cursing in return. tried ignoring him but that didin't work either. We are now ignoring the small things and reporting to major issues to our HOA and city police. He has been cited for letting his dogs run at large and has had numerous complaints, only 2 of which were filed by us.

We decided to sell our house and move elsewhere in July. As soon as our sign went up he started parking directly in front of our house, blocking the For Sale sign and information box from view. We were denied mail service on several occassions because he was too close to the mailbox. We've contacted our HOA and they have sent several letters -- no change in behavior.

I wrote a detailed letter to the board with supporting evidence (photos of his car in front of our house over a 2 week span, police records) and we are scheduled to both appear at the next HOA meeting. There is technically no covenant against parking on the street, but this will fall under the nuisance clause along with everything else.

What can I do to urge the board to take stronger action? What are they legally required to do to help us? If we aren't satisfied with their response what can we do legally?

**A: this is easy. You had and have every right to hire your own attorney to sue this person for harassment etc.

If we take legal action, do we have to disclose that to potential buyers? Can we sue after we've moved to our new house?

Also, will he be responsible for our legal fees if we win?
