owner's use of an easementWhat is the name of your state (only U.S. law)? Washington My property has an easement granted to my neighbor behind me so he can access his property. It is a driveway. I would like to use the driveway to access the back of my property so I can put in a barn and park my RV. Do I need his permission to use the driveway? If he grants me permission, should I have it put in writing so the next owner can use the driveway? Should I deed him the land and get an easement from him? What are my options...? |

| Q: Do I need his permission to use the driveway? A: No. The easement gives the neighbor permission to use the driveway, but you still maintain the right to possess and enjoy it. You are only limited in that you cannot interfere with your neighbor's right to use the driveway according to the terms of the easement. As you stated, it is your property. HI-YAAAAAA!

| actually, there is a possibility that you may not be able to use the easement. It is not common but still possible. You need to read your easement agreement. If it states the dominant tenant has exclusive use of the easement, some courts have read that such that it does prohibit the serviant tenant from using the easement.
