my grandmother died in 2002. In her will, she left her house in a life estate to my uncle for as long as he wanted to live there, with my dad and aunt having remaining interest in the property 50/50 should my uncle decide not to live in the house or at his death.
The estate went into probate. Before the probate was concluded, my aunt died. When the probate ended, my dad and aunts estate signed their interest in the home to my uncle so that he could take out a mortgage, get homestead exemption on the house. The house was deeded to my uncle (tax records show ownership being transfered from probate to my uncle solely). he took out a mortgage on the property, again solely in his name. He got behind and ask me to bail him out. I then purchased the home from him via $20,000 cash and he quit claimed the house to me. it was recorded and tax records show me as owner.
i am now selling the house, my aunts children have now come out and are trying to claim part ownership rights. Do they have a valid claim? |
