i own a several pieces of rural property in michigan. one of these pieces has an easement allowing a neighbor to access some undevolped property.this agreement has been in place for several
years without a problem.

i recently installed a drive through the property that carries the
easement agreement. i had the drive installed over the existing
culvert and followed the path that both myself and my neighbor
had been using to reach our properties.

my neighbor is now insisting on installing his own drive across
my property claiming it is his "right" to have his own drive.
i don't want another drive on that property since it would make
the entire property one big driveway.

he claims his "cousin, the lawyer" will sue me for free if i don't
comply with his wish. i really don't have a lot of money to hire
an attorney if he can ultimately get what he wants. since i own
the property can i deny his demand?

The easement agreement must be followed. Neighbor does not have a right to your property only to the easement area.

reply to ownerhip rights

the easement agreement is very vauge. it simply states the
front piece of property as the easement area. if there already
is a drive that serves both properties can he install another
against my will

cannot imagine how your neighbor could do so legally . your best bet may be spending the money to consult with a lawyer ,

ok sorry to be so dense. i still don't understand if my neighbors
right to ingress and egress allow him the right to a separate
drive when there is already one in place along the same pathway
he has been using for years.

Gus your nieghbor according to the easement is able to have use of easement area. That doesnt mean the nbr can make any changes to land wich is not his . He has only use of the area to access his land . Any idea he has about doing what ever he wants to your land is mistaken . He cannot do so If he does then he risk being open to lawsuit . gus your best bet again is to go see a lawyer tell the lawyer what is happening and perhaps the lawyer will draw up a letter telling the neighbor what can happen to him if he does this . hopefully that letter will just be the end of it . But do seek a local law firms assistance
