I bought my new house at in NJ with mandatory HOA in 1999. I have boat. I am parking the boat in my backyard now. The HOA regulations I was given do not have any issue about parking boat or other vehicles in my property.

About one month ago, I received a letter with an attachment from the HOA. The attachment is a copy of a letter issued to all residents in last year (I never received it though). That letter says that boats parking in either driveway or backyard creating a bad view, owners have to rearrange them. The letter to me stated that I had violated the rule for parking my boat at my backyard and I have to move it away, otherwise a fine will be charged. Last week, I did receive a $50 fine.

I have questions:
1. If HOA has the right to change the existing rules and/or add new rules (or explain the existing rule in such a way) and force all members to follow?
2. Even they have the right, is that rule legal to prohibit me to park my boat at my property?

Any advice is greatly appreciated.

Park boat


Thank you a lot.

What can I do if I want to keep my boat. Is it helpful to hire a lawer?

An attorney may be able to find some loopholes.
