Partition Action

I need to file a partition action against my ex-husband who has refused for 4 years now to remove my name from our mortgage. I do not have the money to hire an attorney or I would have obtained a proper divorce in the first place and would not be going through this. How do I file a partition action? I cannot locate the form anywhere and cannot find an attorney who will help me.

I could not locate a form either, as there most likely is no preprinted form for this type of action. In this situation, the attorney would make his own complaint requesting that the Court grant the motion to partition the property. A real estate attorney can help you. Save up some money so you an hire one or try the local Legal Aid office.

If you did not get a proper divorce, what improper divorce did you get? And is your ex-husbands name Wallace by any chance?
