I have power of attorney for 75% majority family members of jointly owned, undivided, ranch property. We all live in Texas, except our elderly aunt who holds the other 25% of the undivided property in Bryan County, Oklahoma. She is eighty-one years old, destitute, mentally ill, and adversarial. She lives in a car on the property and refuses to allow Adult Protective Services or the Choctaw Nation to assist her and does not qualify for social security. The only income she has is the pasture lease income of which we give her 100%. It is not enough to live on. The family members that retain the other 75% do not have the ability to assist her and draw no income from the property. She refuses to allow sale of the property that would provide her the ability to live out her life in comfort. We have basically given up trying to help her because she refuses to help herself and her mental capacity is impossible to work with. She is basically a bag lady that owns property. She cannot comprehend the concept that she needs to use her own resources during her life time to improve her lifestyle. Is a partition sale our only option to help her?
