partnership dissolution and house settlement

What is the name of your state? CA

I purchased a triplex with my (same sex) partner four years ago. I used separte monies for the downpayment as her income did not qualify towards the mortgage loan, and have paid for most of the expenses, but we hold title equally as TIC. I do not have a domestic partnership agreement nor a property agreement. Is my ex-partner entitled to half of the equity or profit from the rents? What is the best way to proceed with or without litigation?
