We have lived in our home in So. Calf. for over 5 years. Our neighbor has told us they recently had a surveyor and the 6' brick wall that separates our properties (the wall has been there for over 15+ years) is actually 3-ft. onto their property. They want to tear it down and build and put a chain link fence in place to gain that 3'. We never knew this when we purchased our home. This will destroy all our gardens, a waterfall and pond we built... terribly ruining the look of our backyard. Plus with the chain link fence, we will be forced to view all their dogs, all their vehicles, RVs, tires and trash they collect. Help! Can we do ANYTHING?

**A: that's because you never got a survey when you bought or got one and never looked at it. If you did, you would have discovered this problem before closing.

**A: this would not be the neighbors problem but your own. You should have verified the correct property boundary line before making these gardens and water features.

**A: you would not be forced to as you would be free to construct your own 6' brick wall on your owm property hiding the chain link fence.

The older son (who is 40) sleeps in an abandon trunk on their property as well.... Help! Can we do ANYTHING?

**A: so what does this have to do with real estate law?
Maybe offer them some money to sign an encroachment agreement to leave the wall in place "as is".
