Property Bought with Inheritance


What is the name of your state? Tennessee

In Jan. 2004 my parents passed away and I was left with their home. I put it up for sale and bought a home in TN when my property in CA closed. I was married at the time but my parents left everything in to me alone. When I wired the funds to the title co in Tn, it was in my name. Stupid me, when I went to sign the papers in TN, I put my husbands name on the title as well. Last May my EX husband met a woman on the internet and left me and our 3 kids to move in with her and her son. Now he is trying to make me sell the property and wants 1/2 of it. Even if I can prove that this was from an inheritance is this still considered marital property? I would like to have his name taken off the deed, refinance it and stay there with my kids. Is there anything I can do?

Find a really good local real estate attorney. Or a really good divorce attorney, who has a buddy that specializes in real estate law.

Your question, and subsequent divorce proceeding, mean you need live local help ASAP.

Stupid yes. YOu converted separate property to Marital property.

In addition to BB's advice, you could also try and buy out his interest in the house. Maybe once he realizes he will have to hire a lawyer and it may take a year or two for the partition to happen he might be amenable to a buy-out.
