indiana: we are trying to improve the appearance of our neighborhood and for over a year we have tried to get our town council to enforce the town's zoning ordances. at one point our council susperceded our subdivision's convenant and there are members of the council who are currently in violation of such zoning ordances. these ordances are being selectively enforced and this lack of enforcement has made our neighborhood a less desireable area to live. can we make a case that through the town's actions, ie. failure to enforce the town's ordances, that our property value has been harmed and that the chances of every recorvering from that harm, for all intents and purposes, is nearly impossible?

Yes, you can make any case you want, but there are issues to consider such as politics, old boy network, judges etc. Get some feedback from some good attorneys to see if such a case would be worth it.
