Neighbors on our road have recently made repairs to that road. They sent us a bill for those repairs with a note stating that if we didn't pay the bill, they would put a lien on our property. Can they do this? We have signed no contract for the work and the road is actually our property to begin with. Can they do this?

No, but that doesn't mean they won't try. Did the repairs benefit them or did you just sit on the porch sipping lemonade while they repaired a road under the impression that you had hired them?

Check out TX law on liens - Property Code, Title 5.
Chapter 53 (mechanic's lien) doesn't apply because they did not furnish the labor under a contract with the owner.

If they file a mechanic's lien, you can sue them to declare the lien invalid & get your attorney's fees reimbursed, if the court orders it.


Have your attorney write them a hammer letter to make them go away.
