Property Line

What is the name of your state? Colorado...I purchased a house in 2002 that was built in 2000. I recently had a land survey completed and it revealed that my home is approximately 12 feet onto the vacant lot next to me. A review of public records indicate that the lot is owned by the contractor who built my house. Since he built the house outside of the property lines is he liable? Should he not simply give me the 12 feet??? What recourse do I have???
