property line dispute


What is the name of your state? west virginia. i was notifyed today that part of my house was built on someone elses property .the individual that notified me said he had purchased this piece of property by way of back taxes and wanted t oknow if i wanted to purchase the small piece of property.i have lived in the house for 24 years and this is the first time anyone has contacted me over this .we were never aware of this .we live in a home built by jim walters and you would have thought they would have did a survey on property since they take the property as collateral.any help would be greatly appreciated

Have you hired a surveyor so you can prove or disprove what you were told ? Have you spoken with a attorney ? If not and you dont know of a atty go arrange for a consultation using this web sites FIND A LAWYER link up top , Your going to need help with this now .

Writer, check with your attorney to see of you meet the criteria for adverse possession.

In West Virginia you have adverse possession on your side. Try to work it out with your neighbor so it soesn't end up in court. You will prevail, however, you will have to pay to have an attorney to represent you. Go to the courthouse in your area ( prothonatary) and ask that they print you a copy of adverse possession laws in your state. If your neighbor is smart he or she will let it be.

**A: how do you know that the writer would prevail in an adverse possession lawsuit? Do you know the adverse possession requirements in WV and confirmed that the writer even met those requirement?

The party stated that they have owned the property for 24 years. In West Virginia adverse applies after 21 years. So, yes I am familiar with West Virginia Real Estate Laws.

**A: that's interesting. WV Common Law Code 55-2-1 states 10 years.
But that is not my point. The main point is that you do not know if the writer has complied with all to meet the test of adverse possession.
