What is the name of your state (only U.S. law)? Florida
My sister, her boyfirend and his sister bought a townhouse of which they are all on title and the mortgage. He pays the mortgage. Him and his sister both are not living with her but live in New York. They are in the middle of a break up but she's afraid that she will be kicked out and loose her interest she paid for the down payment in her home. What are her rights if she is only one living there besides their daughter?

Who is residing there doesn't change ownership or responsibility for the debt or equity.

As the owner she can reside there.

"Him" may stop paying the mortgage. If he does and she doesn't step up and pay, the house will be foreclosed.

If they are splitsville, the parties involved should try to negotiate to sell the property or buy one or the other's interest out (and refinance).
