The Company I work for owns property adjoining the Columbia, South Caolina Airport--CAE! Three years ago An Attorney and Representative for the Airport sent us a letter stating the following.

"This letter will confirm that the Airport Commission has determined that acquisition of the parcel is necessary for the public purpose of enhancing the safety of airport operations. Acquisition of the parcel is consistent with conversations the Airport has had with FAA staff and will most probably be shown on the updated Airport Master Plan, which is in process now. The Airport is committed to acquiring the parcel by either negotiation or procedures of eminent domain pursuant to title 28 of the code of laws of South Carolina."

This letter was sent October 28. 1999. The Airport sat on their hands until recently then making us an offer of $100,000.00 less than we owe on the said property and over $500,000.00 less than what we have in the property including interest and tax payments.

What recourse do we have when we believe the Airport is not acting in good faith. By what laws do they have to act fairly and expediently. It appears they are trying to run us out of money when you consider our payment on this property is $10,000.00 a month pluss anual property taxes.

The real kicker is. In October of 1999 they purchased large parcels of property at twice what they offered us. I have good reason to believe political implications are involved. Our property is worth much more than the other property purchased.

What can we do before we go broke.

Speak with a local law firm and see If the airport commision can do a eqaul land swap where they can offer nearly the same land and building with decent access to roads etc , that may well work quite well for you , get your own market evaluations done for that property too . But do speak with a law firm
