Question

Question about a fence....


We farm and ranch in both South Dakota and North Dakota. We lease a few different parcels of land---some of which is through the Standing Rock Tribe----this year they have pulled all the leases and are requesting a minimum bid that they have set. It is getting too pricey for us and we are thinking of not renewing our lease. But the problem is that our parents and now us---have leased these parcels for over 50 plus years and there is no fences between our land and tribal land. Does the law read that on quarterline fences that each party has to fence half?----Or if we do fence our half and then expect the tribe to fence the other half---they don't---and our cattle cross onto tribal land---will we be held for trespassing? We need to find out about this issue in just the next few days as the tribe has set a deadline. Does anyone have an answer?

**A: the law requires that an owner fence their own property if they want the property secured. So ifyou have cattle, you fence in your own property.
