What is the name of your state? CA
My aunt Quit Claimed property to my mother.My aunts' deed list her and her husband.My aunts' husband has died.The county registar say a new Quit claim is neccesssary to convey the 50% interest her dead husband owned,even though she has right of surviorship.My mother has died and left her estate to her three children.I have not compleated probate at this point.
For the new Quit Claim: Is it from an individual (my aunt)? To an individual (my deceased mother)? or to the estate? or to the three children who will inheiret the estate? The original Quit Claim was for $1.00 consideration. The couty registar says this is not possible.Should I make it a gift? Thank you for any help you can give with this matter.
