Quit Claim Deed


What is the name of your state? Colorado
I am getting divorced and want to know if my husband does a Quit Claim Deed on the house over to me, does he lose all rights. Can I sell it or leave it my will to anyone else with out his signature in the future. Also I am doing a QCD on the land over to my husband do I lose all rights to the land?

Before EITHER of you go around Quit Claiming anything, you should FIRST:

1. Complete the divorce, including the property transfer as part oof the agreed propertyu settlement.

2. each run a title search from last deed forward, to be certain that no liens, judgements, or pending lawsuits, etc are out there against the other parties interest that would affect title.

3. Refinance the other OFF the existing mortgage obligations. The QC can be held by the title company ot closing agent to be released upon mortgage payoff. The lender can and will continue to hold ALL parties who are signors of the mortgage RESPONSIBLE in the event of a default until that mortgage is paid off and satisfied, , even if they no longer own the property.
