You said it was probably too late to have the neighbors pull back the deck.

I had the City send an enforcement letter and they (the new neighbors) have an option for a variance, which the city won't give. Reason: its not special circumstance and they have another section of the yard that they might be able to build in. Even if the city would grant the variance I can appeal the decision.

Its unfortunate, the former owner sold to these new people. They are now responsible. My guess the new people had the seller reduce her price because of the deck that will be reconstructed to zoning code.
