My husband had purchase a house back in 2001 for his brother to live in with the understanding the house be out his name with in 2 yrs. Well, that has not happen, the house was refinaced in 2004. When they did this there was a check that came in name at the house for the payment to be sent to the new finace company for the insurance that didn't happen his brother forged his name on it and cashed. We have been asking him to get out of my husband name and it will not do it because he has no credit, know he has his dad in on it saying the house in his name and that is not true. The morgage payments still come to us in Eugene name and we hand the payment over to him because he is to make them while he is living in the house. That was the agreement. Nothing was put in writing on this. We have told him we where going to put the house up for sell but he want let anyone look at the house he very rude to everyone. What can we do? My husband would like to free and clear from this and give the keys back to morgage company with going against his credit. Can you give us any advice at all what our option would be.
