Three years ago, I refinanced. The settlement attorney was supposed to payoff 4 accounts. He didn't. My payroll was garnished and I paid them off before the attorney 1.5 years later. The attorney for the payoffs and I contacted the settlement attorney several times and he promised the checks were in the mail. I took the attorney to Upper Marlboro District Court because he has NEVER refunded my money held at settlement to payoff the accounts. Can he keep my money like this? I forwarded him copies of the settled receipts, but he refuses to return my money. The court first entered a default judgment for $4,500 +, but he appealed it, the court mailed me notices to the wrong address so I wasn't there. I've asked his attorney several times for my money but they said they would not give it to me until I sign a document releasing the settlement attorney. Do I have to sign it?

No, do not sign anything except receipt of cashiers checks for the amount due and owing.

Then the real answer is no, the attorney can lose his license for doing that. File complaints with the local Bar Association, the State attorney licensing/disciplinary office and escrow licensing/consumer protection office.

Do you practice this type of law in PG County? I may want to hire an attorney.
