realestateWhat is the name of your state? minnesota what is the time limit to file against an individual who sold u a lemon of a home? There was not a thing in the purchase agreement about "AS IS". thank u Last edited by starfire; 11-10-2002 at 03:32 PM. |

| IAAL .If it was your number 2 item and the person purchased a home that had a holding tank only and failed to notice the red signal light It needs to be pumped . Wich is how many homes on lots that are too small to any other kind of system built & too close to swampy , or marsh , or lake area , or in the case of Saint Paul mns affluent burb of North Oaks where many of the homes have regular size lots most of the older homes there all have only holding tanks with no drain field . |

Did you get a Seller disclosure statement? What are the problems with the home? When did you purchase the property? How did you buy the property ie. bank financing vs. seller financing etc.? There are many other questions but we need to know if you even have a case or not. If you do not have a case, then your statutes of limitations question is moot. |

| answering farmer J - thank u for responding, did not go through a realtor, person was a x realtor - purchases and sells land, etc. no inspection done, seller said he never has them done. i purchsed from person b/4 he closed w/ the owners by a few hours. however i did ask to see the owners truth & lending sheet that i have a copy of he gave me. Loads of things wrong! carpertender aunts, east wall had to be replaced, roof leaks, exterior wood rott needs replacemnt around window... putty, caulking etc is holding the window frames together, water when it rains leaks or dips doen on window interior sills. also took land in the descripion by an easment without informing me. had to have an electican come in & rewire which he said his brother would do when i saw a 220 box outside the meter, after purchased the house the brother said no. |

There are numerous instances so hire an attorney. |

farmer ji realize i was iggnorrant not to have had an attorney , etc, however, do u happen to know the time limitation 4/MN to file these issues? Is it a month , or year period from the purchase/closing date, etc., or occupancy date? i would assume closing date. thank u once again |

The SOL is not months but years and there have been varying discussions on exactly when the clock starts ie. date of closing, date of defect discovery etc. It does not start from the date of occupany. | HG gave you all the answers that work the best dealing with it . The only extra thing I can offer to you are to find out If the city the property is in required a inspection before the sale . ( like Saint Louis Park,GV , Richfield , (Mpls DID when I sold mine ) finding out about that will help a attorney when It comes to planing how to approach the matter. |

| yes i will call the county to see if any regulations/inspections should have been followed 4/ sale. previously contacted the county attorney via phone about the land/easment & was told if it was in description i lost that proprety. funny thing about word easement - i assumed that meant gives a right of way, not that a person can take that away the portion of land & do what they wish with it. a whole new world is opening up & in my last twenty years i may learn to some entirety. good 4/ the gray matter to keep adventuring- yet i can think of more pleasant ways. as enjoying what u purchased & learn the worst thing this individual had been a realtor... persons license expired in 2001, needless to say i found this out may of this yr., eight months a/ my purchase. up north small towns nothing touches money, a nice place to vacation but i rather move back to the mpls. i have often heard ... (but i personally no none), that there are attorneys out there who would love to go a/individuals who burn people, especially when this was my lifes savings. a catch 22, so by the time i pay all fees, etc, i will be back to square one & have nothing, & then where does a person live public housing -thats what i thought i had avoided by saving a lifetime. it seems like i am continuially finding things that have to be done or replaced for general matinance, e.g. water leaking in the top of the molding over windows,, the bottom of a second story window the wood or should have been wood was just caulking. This was new as the rain & wind finally came in that direction w/ the valosity upon the house.. air blows through the windows, i could go on & on but it would be to lenghty. what will the days bring of new structual ailments...my cc card does not want ot know anymore. yes time from birth to death is a learning experience - but that builds character thanks again 4/your help |
