We refinanced our home 2 years ago. We found out several months after the closing that the new mortgage company did not completely pay off our mortgage therefore leaving a balance. My question is: since the new mortgage company obviously does not hold a clear title to the property, what is our obligation to pay them? Would this be considered a breach of contract?

You still have an obligation to pay the mortgage. You need to find out why the ld mortgage was not paid off. Contact the escrow company, old and new mortgage ocmpany and get to the bottom.
