Refinance Settlement Discrepancy


What is the name of your state? Virginia
However, I refinanced property in Florida. The house I refinanced had an FHA loan. Once a payoff statement is requested and a date for payoff is set, an entire month's per diem is charged if the funds are one day late. The mortgage company I used was made aware of this in writing in the payoff statement. I was told by the loan officer on several occassions that the loan would be paid off on the 31st of Jan 2003. I had all closing documents signed and to the refinancing company two days ahead of the due date. The refinancing company however, wired the funds to the title company three days late. I was consequently charged the month's per diem although I did everything I was supposed to do. The mortage company is now blaming the title company and vice versa. I've faxed all the documentation clearly showing the lack of punctuality on the mortgage company's part and requested reimbursement of the per diem. What else can I do to get this resolved?

**A: if funding occured on time and the title company delayed, threaten to sue them or file a complaint with the State. But your post stated that the mortgage company was delayed. If that is true, there is basically nothing you can do.
