I have been living in an apartment for almost 3 years and have sent my rent check on time every month. The landlady has never cashed any of the checks (over $20,000) and when asked about it, she states that she just hasn't had time to get to the bank. Recently I have taken a new job and need to relocate and am concerned about whatI am responsible for. Are the past checks still valid? I am responsible for the whole amount of money?

My response:

Wow ! Most people on this site wish their landlords were that wealthy !!

Anyway, after six months, checks are considered "stale" and cannot be cashed. You kept your end of the bargain by paying her. If it was her choice not to cash the checks, that's her problem . . . and if push comes to shove, let her explain it to a judge. You have no obligation to re-issue checks to her.
