    Repurchase of Land Previously Condemned

    What is the name of your state? North Carolina

    I have owned a piece of land in the North Carolina mountains for about 15 years. This land is owned via Tenancy In Common and there are 3 co-owners. About 7 years ago, the State took a portion of this land through condemnation for the purpose of building a road. Each of the co-owners has a 1/3 interest in the remaining land.

    The road was never built and it was recently discovered that one of the other co-owners bought the portion that was condemned back from the State and is holding title in his name only. This purchase occurred approximately a year and a half ago but the purchase was not known by the other 2 co-owners until recently.

    There is a certain amount of friction between the co-owners, so the communications are not what they should be. I have not been on good speaking terms with the co-owner who repurchased the land previously condemned. Can I legally require the co-owner who repurchased this land to sell me a 1/3 interest which I held prior to condemnation? Did he have a responsibility to communicate the fact he had repurchased this land to the other co-owners? Any help or advise would be greatly appreciated.

    How was the property obtained back from the state? Was it a general sale or something special persuant to the condemation?

    If it was a public sale there's probably little you can do to force the issue. If it was some special offer to the previous owners of the condemned (SCREW YOU HG) land you might have some options.
