right of way rightsmy wife and i own three acres of land in polk county north carolina.we have used an old roadbed for our access to this property as our driveway that runs thru my inlaws property,they also use this roadbed as their driveway,we have since moved and they have blocked our access to our property,stating that we can no longer use their part of the roadbed.we have right of way rights on the other side of our property,but it would cost an excessive amount of money to build a new road.my question is can they legally do this.thanks leslie and tamela p.s.they are my wife's mother and stepfather,and by the way he is a grandfather. | Seems to me like you have the right to continue using this access to your home. Have you tried talking to them? Have you tried crashing thru the roadblock? Is there anything recorded such as an easement or agreement? Is there an easement mentioned on your deed or their deed? (Go to the County Recorder for records) How long has this roadbed been used as access? If it has been a long time you might have rights even without it being recorded. Have you brought the law into this. Maybe they'll fix it for you. Shows you, don't make the in-laws mad at you... |
