I purchased a homein CA with the intention of moving into it in about one year, so when the seller agreed to sell me the house with the provision that he rent back for one yr. that was great! But then I got laid off and now want to move into the house. He did sign a month to month lease with a thirty day notice by either party. Can he sue over the agreement of one yr rent back or does the signed month to month agreement take precedence?
