seller responsibilityWhat is the name of your state? Illinois I sold a house approximately a year and a half ago. After the inspection I agreed to fix the flat roof becaue it needed repair. I replaced the flat roof on my house and the sale was complete. After a year, I get a call from the buyers lawyer asking me to send them 6500 because I did not fix it properly and it started to leak and they had to replace the whole roof and some other things. I was unaware of this problem and I feel that I should not have to pay if I fixed what the inspector suggested that I fix. They are now threatening to sue. Pleae advise |

Pleae advise **A: 1. did you have the Buyer or home inspector inspect the roof after completion and "sign-off" approving and accepting the the work? 2. did you do the work yourself, if so are you a licensed, experienced and qualified roofing contractor? 3. does the state law require a licensed rooofing contractor to have completed the repair work? 4. if a roofing professional contractor did the work, did you give the Buyer a copy of the contract, paid invioce and warranty? Also see #1. 5. are you aware that the residential roofing industry considers flat roofs to be the most troublesome out of all roof types? 6. what type of roofing material was used? Was it the El Cheapo Stop Leako roofing stuff you buy at the nearest hardware store on sale or an industry proven product listed with the Construction Specifications Institute and that would generally be specified by a residential registered architect? 7. in my opinion when working on construction defect litigation cases, the roof was not repaired properly if it starts leaking after just a year. Do you see where I am going with this? |
